It is wrong for public institutions to buy out of NeST

**Penalty imprisonment, fine or both

GOVERNMENT EMPLOYEES who will make public purchases outside of the NeST system will have committed a criminal offense and the penalty is imprisonment and paying a fine, according to the Public Procurement Law of 2023.

The Director of Legal Services of the Public Procurement Regulatory Authority (PPRA), Lawyer Paul Kadushi speaking on the Radio program, has asked the leaders of government institutions and employees in general to comply with the requirements of the law, which came into force on June 17, 2024 and its regulations that have come into force on July 1, 2024.

Lawyer Kadushi explained that the repealed law did not require the use of an electronic system to make purchases, a move that caused many institutions to make purchases outside the system.

“But with this new law, the “Public Procurement Law of 2023″ has now set a mandatory requirement for all procurement institutions to use an electronic system in making purchases,” Lawyer Kadushi said.
